TERMS OF SERVICE

1. INTRODUCTION
Kontainer® is a ticketing and live streaming platform composed of multiple websites, from now on called “Kontainer services”, online applications and multimedia players. Kontainer® is a trademaked child company of NEONMEDIA Multimedia Lda.
The following terms of service (the "Terms of Service") for the Kontainer Service constitute a legal contract between the Promoter or Spectator and NEONMEDIA Multimedia Lda, with registered office at Av Berna, 4,1050-040, Lisbon, Portugal registered with the number nº 506326845, regarding your use of the Kontainer Service.
By using and / or visiting the kontainer.live, the user declares to be in agreement with (1) the Terms of Service and (2) the Privacy Policy (https://www.Kontainer.live/privacy-policy.html). Our Privacy Policy contains information about our policies and procedures regarding the collection, use and disclosure of information that we receive from Users. If you do not agree with the Terms of Service or the Privacy Policy, please do not use the Kontainer Service.
Kontainer reserves the right, to change, modify, add, or remove portions of the Terms of Service at any time. Please periodically check the Terms of Service for changes. The continued use of the Kontainer Service after the posting of changes constitutes your mandatory acceptance of such changes.

2. Ownership
The data and materials of the Kontainer Service, except Content Submissions (defined below), including, without limitation, texts, graphics, interactive features, logos, photographs, music, videos, software and all other audio and visual materials are intellectual property of Kontainer®, its licensors and its suppliers. The Materials are protected by copyright, patents, trademarks and other laws, international conventions and proprietary rights. All ownership rights of Materials remain with Kontainer, its licensors or its suppliers, as appropriate. All trademarks, service marks and trade names are property of Kontainer and / or licensors. Except when expressly authorized by Kontainer, the user agrees not to sell, license, distribute, copy, modify, perform or publicly display, transmit, publish, edit, adapt, create derivative works on, or make use of the Materials.

3. Kontainer Service License
Kontainer allows (a) certain users referred to as "Promoters" to distribute and display live or VOD videos ("Kontainer Shows") and to distribute, publish and display text and photo comments and personally identifiable information commonly known as "name and image" and (b) to certain users referred here as "Spectators" see the "Kontainer Shows". The Kontainer Shows, Promoters' comments, Promoters' name and image, along with all other texts, files, images, photographs, videos, sounds, musical works, author works, applications or any other materials submitted, displayed, posted, posted or transmitted via the Kontainer Service by Promoters are collectively referred to as "Content Submissions".

4. Promoter and Spectator License
The Promotor is solely responsible for his own Content Submissions and the consequences of their publication. In relation to Content Submissions, the Promotor states, represents and / or guarantees that: (a) the Promotor is the creator and owner and / or has the necessary licenses, rights, consents, launches and permissions to use and authorize Kontainer to use their Content Submissions as necessary to exercise the licenses granted by the user in this section and in the manner contemplated by Kontainer, Terms of Service (b) your Content Submissions do not and will not: (1) infringe, violate or misappropriate any third party right, including any copyright, trademark, patent, trade secret, moral right, right to privacy, publicity right or any other intellectual property or property right or (2) defaming or slandering any other person.

The Promotor retains all proprietary rights of his Content Submissions. However, the Promotor, through the distribution or dissemination of Content Submissions through the Kontainer Service, grants Kontainer a global, non-exclusive, freely transferable, assignable, fully paid, royalty-free license to host, display, execute, reproduce, distribute, compress or convert to streaming, and otherwise exploit Content Submissions, in any streaming support format in order to publish and promote those Content Submissions on connection with the services offered by Kontainer.
When distributing or disclosing Content Submissions through the Kontainer Service, the Promotors grants each user of the Kontainer Service that is authorized to access his Content Submissions a personal, non-commercial, non-transferable and non-exclusive license to access and view their Content Submissions.

5. Tickets

To watch a KONTAINER SHOW, the user purchases a Ticket through which they are granted Spectator access to that same Show. This Ticket is purchased through the KONTAINER platform provided by a third party player and, after payment, is immediately available. The Ticket is personal and cannot be transferred to another user. The Ticket allows you to watch a KONTAINER Show at most on one device simultaneously and for a period of time defined by the Promotor.

Tickets are not exchanged or returned, except in the event of changes or cancellations of the KONTAINER Show. Content Submissions is the responsibility of the Promoter. KONTAINER does not assume, under any circumstances, the Promoter's obligations and responsibilities.

6. Quality of Service
The quality displayed by KONTAINER Shows content may vary from device to device and can be affected by a variety of factors, such as the user's location, available bandwidth and / or the speed of their Internet connection. KONTAINER Shows are encoded and distributed in a variety of resolutions known as “Adaptive Bitrate” with the higher resolution to be 1080p at 6Mbps bitrate. Bitrate can be different from show to show and is the promotor responsibility to have a dedicated line and enough bandwidth to deliver a proper bitrate for distribution. The availability of high definition (HD) content is subject to the services and features of your device. The default settings for playback on cellular networks include high definition (HD) content but a download speed of at least 4.0 Mbps is recommended for receiving HD content (720p resolution or higher). The user is responsible for all costs of accessing the Internet, so it is advisable to consult your Internet provider for information on possible costs of using Internet data.

7. Disclaimer
KONTAINER.live is hosted on AWS and declines any responsibility for damages that may arise as a result of using the KONTAINER Service. There is no guarantee that access to this website will be uninterrupted 100% of time or free from errors, viruses or any other harmful material and is not subject to claims, penalties, damages or expenses that may arise from either use or disability.
